Terms of Service

1. Agreement to Terms

By accessing or using Qualixir ("the Service"), operated by Arzaan Consulting Inc, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Qualixir is an AI-powered quality assurance testing platform that provides automated test generation, execution, AI vision evaluation, report generation, and training documentation generation. The Service is provided as a cloud-based SaaS platform with optional on-premise worker deployment.

3. Account Registration

You must register for an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate, current, and complete information during registration.

4. Subscription Plans and Billing

The Service offers multiple subscription tiers (Starter, Growth, Professional, Enterprise). Paid subscriptions are billed monthly or annually based on your selection. Prices are in USD unless otherwise stated. You authorize us to charge your payment method for the subscription fees. Subscription renewals are automatic unless cancelled before the renewal date.

5. AI Token Usage

Each subscription tier includes a monthly AI token allocation. Tokens are consumed during test execution (AI vision verdicts), test generation, and training document generation. Unused tokens do not roll over to the next billing period. Overage handling varies by tier as described on the Pricing page.

6. Your Data

You retain ownership of all data you upload to or generate through the Service, including test documents, test cases, screenshots, reports, and training documentation. We do not claim ownership of your content. We process your data solely to provide the Service.

7. AI Processing

The Service uses AI for vision evaluation, test generation, and content generation. Screenshots and test data sent to the AI processing provider are processed but not retained and are not used for AI model training, per the provider's data usage policy.

8. Acceptable Use

You agree not to:

• Use the Service to test applications you do not own or have authorization to test
• Attempt to bypass rate limits, token allocations, or tier restrictions
• Reverse engineer, decompile, or disassemble the Service
• Use the Service for any illegal or unauthorized purpose
• Share account credentials with unauthorized users

9. Service Availability

We strive to maintain high availability as defined by your subscription tier's SLA. We do not guarantee uninterrupted access and are not liable for downtime caused by maintenance, third-party service outages, or force majeure events.

10. Data Retention

Test data, screenshots, and reports are retained according to your subscription tier's retention period. Upon account termination, your data will be deleted within 30 days unless a longer retention period is required by law.

11. Limitation of Liability

To the maximum extent permitted by law, Arzaan Consulting Inc shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

12. Termination

Either party may terminate this agreement at any time. You may cancel your subscription through the application settings. We may terminate your account for violation of these terms with 30 days' notice, or immediately for egregious violations.

13. Governing Law

These Terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Calgary, Alberta.
